Beginning on January 2, 2019, all short-term rental operators will be required to register and apply for a permit with the City of Coppell. Any residential property or portion of a property that is rented out on a short-term basis – for a period of fewer than 30 days – is considered to be a short-term rental. This includes homes that are listed for rental on Airbnb, VRBO Vacation Rentals, HomeAway and similar websites.
In June 2018, after evaluating concerns from residents and rental property owners, the Coppell City Council unanimously approved an ordinance to regulate short-term rental properties and ensure the safety and security of Coppell neighborhoods. Per the ordinance, short-term rental operators must register their property with the City and schedule and pass a City safety inspection. The ordinance also outlines restrictions on the number of guests and vehicles that are allowed at the rental properties. In addition, the operator will be required to pay a quarterly Hotel Occupancy Tax.
In addition, short-term rental operators will also be required to provide renters with contact information, a 24-hour hotline number and a brochure that outlines tenant conduct expectations and safety information.
Once the yearly short-term rental permit is issued, a notice will be sent to all property owners within 100 feet of the rental property. The notice will include the contact information for a 24-hour complaint hotline.
"I value property rights, which are the bedrock of our country, but there are property rights on both sides," said Councilmember Gary Roden. "I abhor extra regulation, but we already have regulation in our town against businesses in neighborhoods…I was co-chair of the 2030 Strategic Planning Committee, and one thing that came out of that, above all else, was protect our neighborhoods. I think that's what the essence of this does…Ultimately, when I look at something like this, my thought is, 'Would I want this next door to me?'"
This ordinance does not prohibit short-term rentals, but it does allow the City to monitor short-term rental properties in order to protect the integrity of Coppell neighborhoods and the safety of the community.
The ordinance includes a sunset clause, which will allow the City Council to monitor the effect of the ordinance and make adjustments as needed in the future. All current short-term rental operators have been notified of the upcoming changes. The ordinance did not take effect immediately after approval in order to allow ample time for property owners to prepare for the ordinance requirements.
